Preamble
These Terms and Conditions govern the relationship between Balearic Collection S.L. (Balearic Collection, we, us, or our) and any individual or entity (Client, you) who engages our services, whether through our website www.baleariccollection.com, by email, telephone, WhatsApp, or any other means of communication.
By submitting an enquiry, signing a Service Agreement, paying a deposit, or confirming a booking with Balearic Collection, you confirm that you have read, understood, and agreed to these Terms in their entirety. If you are acting on behalf of a group or another person, you confirm that you have authority to bind all members of that group or that person to these Terms.
Balearic Collection S.L. is a licensed travel agency. Licence: AVBAL/885, issued by the Consell Insular de Mallorca, Turisme. The business is conducted in compliance with Balearic Islands Tourism Law 8/2012, Royal Decree-Law 23/2018, and Law 34/2002 (LSSI-CE).
1. Definitions
- Services: all travel planning, concierge, bespoke itinerary design, booking, coordination, and ancillary services provided by Balearic Collection, whether or not they constitute a Package.
- Package: a combination of at least two different types of travel services purchased together for the same trip at an inclusive price, as defined under Spanish Royal Decree-Law 23/2018 implementing EU Directive 2015/2302 on Package Travel.
- Service Charge: the fee charged by Balearic Collection for its planning, curation, and coordination work, as set out in the separate Service Charge Agreement.
- Supplier: any third-party provider of travel-related services, including hotels, villa owners, transport operators, yacht charter companies, restaurants, experience providers, and airlines.
- Booking: a confirmed reservation of a Supplier's service made by Balearic Collection on the Client's behalf.
- Itinerary: the personalised travel programme prepared by Balearic Collection for the Client.
- Lead Client: the individual who submits an enquiry or signs the Service Agreement on behalf of a group, and who is jointly and severally liable for all obligations under these Terms.
- Force Majeure: any event beyond the reasonable control of Balearic Collection or a Supplier, including acts of God, natural disasters, pandemics, war, civil unrest, strikes, government actions, or infrastructure failures.
2. Our Services
2.1 Scope
Balearic Collection provides bespoke travel planning and luxury concierge services for travel to and within the Balearic Islands (Mallorca, Menorca, Ibiza, and Formentera). Services may include:
- Personalised travel consultation and itinerary design
- Villa, hotel, and accommodation search, recommendation, and booking
- Private transfers, yacht and boat charters, and helicopter bookings
- Restaurant reservations and private dining arrangements
- Excursion, experience, and activity bookings
- Concierge and on-island support during the Client's stay
- Coordination with third-party Suppliers on the Client's behalf
2.2 Agency Role
Unless explicitly stated otherwise in writing, Balearic Collection acts as agent on behalf of the Client when making bookings with third-party Suppliers. In this capacity, the contract for each Supplier service is formed directly between the Client and the Supplier, and Balearic Collection is not a party to that contract.
Where Balearic Collection arranges a Package as defined in Clause 1, the provisions of Section 10 (Package Travel) apply in addition to these Terms.
2.3 Bespoke Nature
All Itineraries and service arrangements are created specifically for each Client. The time, expertise, and costs invested in preparing a proposal are substantial. Our Service Charge reflects this work regardless of whether all, some, or none of the proposed elements are ultimately booked.
3. Enquiry and Booking Process
3.1 Enquiry
Clients may submit an enquiry via our website, email, telephone, or WhatsApp. An enquiry does not constitute a booking or create any contractual obligation on either party.
3.2 Proposal
Following an initial consultation, Balearic Collection will prepare a personalised proposal and/or Itinerary. Proposals are indicative and subject to availability and price confirmation at the time of booking.
3.3 Booking Confirmation
A Booking is confirmed when all of the following conditions are met:
- The Client has signed the applicable Service Charge Agreement
- The Service Charge deposit has been received by Balearic Collection
- The Client has confirmed acceptance of the Itinerary and Supplier-specific terms in writing
- Any deposit required by a Supplier has been paid
Balearic Collection reserves the right to decline any enquiry or booking at its sole discretion and without obligation to provide reasons.
3.4 Lead Client
The Lead Client accepts these Terms on behalf of all members of the travelling party and is responsible for ensuring all members comply with these Terms and any Supplier-specific terms. The Lead Client is jointly and severally liable for all payments due.
3.5 Bookings via Third Parties
Where a booking is made by a personal assistant, executive assistant, family office, or other third party on behalf of the Client, that third party represents and warrants that they have full authority to act on the Client's behalf and to bind the Client to these Terms. Balearic Collection is entitled to rely on this representation without further verification.
4. Pricing and Payment
4.1 Service Charge
Balearic Collection's Service Charge is set out in the separate Service Charge Agreement. It is payable for planning, curation, and coordination work and is due regardless of whether the Client proceeds with all, some, or none of the Supplier bookings recommended.
4.2 Supplier Costs
All costs for Supplier services are in addition to the Service Charge and are clearly itemised in the Itinerary and booking confirmation. Supplier costs are quoted in EUR and are subject to change until confirmed in writing by the Supplier.
4.3 VAT and Local Taxes
All prices are quoted inclusive of applicable Spanish IVA (VAT) unless otherwise stated. The Balearic Islands tourist tax (Impost de Turisme Sostenible — ecotasa) is payable directly by the Client to the accommodation provider on arrival and is not included in quoted prices unless explicitly stated.
4.4 Payment Schedule
Unless otherwise agreed in writing:
- Service Charge deposit: due on booking confirmation, as set out in the Service Charge Agreement
- Supplier deposits: due as required by individual Suppliers and communicated at the time of booking
- Balance of Supplier costs: due 56 days (8 weeks) before the first service date, unless a Supplier requires earlier payment
- Bookings made within 56 days of the first service date: full payment due upon booking confirmation
4.5 Payment Methods
Payments are accepted by bank transfer (IBAN) in EUR. Payment details are provided on each invoice. Balearic Collection does not accept cash payments for Supplier costs.
4.6 Late Payment
If any payment is not received by the due date, Balearic Collection reserves the right to suspend work on the Itinerary, release provisional Supplier bookings, and/or treat the engagement as cancelled in accordance with Clause 6.
4.7 Price Variations
Quoted Supplier prices are indicative until confirmed. Once confirmed, prices are fixed except for changes arising from: government-imposed taxes or levies; transport fuel surcharges; or currency fluctuation exceeding 2% where costs are incurred in a currency other than EUR. Increases below 2% of total booking value are absorbed by Balearic Collection. Increases exceeding 8% entitle the Client to cancel without penalty and receive a full refund of Supplier costs paid.
5. Changes Requested by the Client
5.1 Itinerary Amendments
Requests to amend a confirmed Itinerary must be submitted in writing by the Lead Client. Balearic Collection will use reasonable endeavours to accommodate changes, subject to Supplier availability. Supplier amendment fees will be passed to the Client in full.
5.2 Change of Travellers
The Lead Client must notify Balearic Collection in writing of any change to the composition of the travelling party. Certain Suppliers may not permit name changes or substitutions. Any costs arising from a change of traveller are the Client's responsibility.
6. Cancellations
6.1 Cancellation by the Client
All cancellations must be notified in writing to contact@baleariccollection.com. The date of cancellation is the date written notice is received. The following charges apply to Supplier costs, in addition to any non-refundable elements imposed by individual Suppliers:
- More than 60 days before first service date: deposit forfeited; balance refunded less any non-recoverable Supplier costs
- 31 to 60 days before first service date: 50% of total Supplier costs, or the amount non-recoverable from Suppliers, whichever is greater
- 15 to 30 days before first service date: 75% of total Supplier costs
- 14 days or fewer before first service date: 100% of total Supplier costs
The Service Charge is non-refundable in all circumstances once planning work has commenced, as set out in the Service Charge Agreement.
6.2 Cancellation by a Supplier
If a Supplier cancels a confirmed Booking, Balearic Collection will use reasonable endeavours to source a suitable alternative of equivalent standard. If no suitable alternative is found, the Client will receive a full refund of amounts paid for that specific Booking. Balearic Collection is not liable for any further loss beyond the refund of amounts actually recovered from that Supplier.
6.3 Cancellation due to Significant Price Increase
Where a confirmed Supplier price increases by more than 8% of the total booking value, the Client may cancel without penalty and receive a full refund of all Supplier costs paid. The Service Charge remains non-refundable.
6.4 Cancellation due to Force Majeure
Where a Booking cannot proceed due to Force Majeure, Balearic Collection will use best endeavours to recover funds from Suppliers on the Client's behalf. Refunds reflect amounts actually recovered. Balearic Collection is not liable for unrecoverable costs arising from Force Majeure events.
7. Changes or Cancellations by Balearic Collection
Balearic Collection reserves the right to make changes to a confirmed Itinerary in circumstances beyond its control. The Client will be notified promptly, offered a suitable alternative where possible, and provided a proportionate refund where no suitable alternative is available. In the unlikely event of a full cancellation by Balearic Collection prior to commencement of services, the Client will receive a full refund of all amounts paid to Balearic Collection.
8. Liability
8.1 Balearic Collection's Liability
Balearic Collection accepts liability for its own negligence in the performance of its planning and coordination services. Our liability is limited to direct losses caused by our proven negligence and shall not in any event exceed the total Service Charge paid by the Client for the relevant engagement.
Balearic Collection S.L. maintains a civil liability insurance policy in accordance with Article 58 of Balearic Islands Tourism Law 8/2012, with minimum coverage of €450,000 across the following three blocks:
- Operational business liability (responsabilidad civil de explotación) — minimum €150,000
- Direct or subsidiary liability (responsabilidad civil directa o subsidiaria) — minimum €150,000
- Primary financial loss liability (responsabilidad por daños patrimoniales primarios) — minimum €150,000
8.2 Supplier Services
When acting as agent, Balearic Collection is not liable for the acts, omissions, or negligence of any Supplier, nor for injury, illness, damage, loss, delay, or additional expense caused by events beyond Balearic Collection's control. The Client's recourse in such cases is against the Supplier directly.
8.3 Exclusions
Balearic Collection is not liable for: the Client's failure to comply with Supplier terms; the Client's failure to hold adequate travel insurance; indirect, consequential, or special losses of any nature; loss or damage to personal property; or any Force Majeure event.
8.4 Non-Excludable Liability
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable Spanish or EU law.
9. Travel Insurance
Balearic Collection strongly recommends that all Clients obtain comprehensive travel insurance before confirming any Booking, covering cancellation, curtailment, medical expenses including repatriation, personal liability, and loss of luggage and personal effects. Balearic Collection does not sell travel insurance. The absence of adequate insurance does not affect or limit the Client's liability under these Terms, including in respect of cancellation charges.
10. Package Travel
Where Balearic Collection arranges a Package under Spanish Royal Decree-Law 23/2018:
10.1 Pre-Contractual Information
Before confirming a Package Booking, Balearic Collection will provide all required pre-contractual information, including the main characteristics of the Package, total price, payment schedule, cancellation conditions, and travel document requirements.
10.2 Insolvency Protection and Financial Guarantee
Balearic Collection S.L. maintains the financial guarantee required under Article 58 of Balearic Islands Tourism Law 8/2012:
Minimum value: €100,000 (equivalent to no less than 5% of annual turnover)
Policy No. 86531729 — AXA Seguros G.
This guarantee remains active for two years following definitive deregistration of the agency, covering liabilities established for package travel during that period. In the event of Balearic Collection's insolvency, this guarantee provides for the refund of payments made for undelivered services and, where applicable, repatriation of travellers.
10.3 Significant Changes
Where Balearic Collection must make a significant change to a Package before departure, the Client will be notified immediately and offered the choice to: accept the change; transfer to an alternative Package of equivalent or superior value if available; or cancel with a full refund of all Package payments.
11. Client Responsibilities
The Client is responsible for:
- Ensuring all members of the travelling party hold valid passports and any required visas or entry documentation for the Balearic Islands and any transit countries
- Disclosing any medical conditions, dietary requirements, mobility restrictions, or special needs at the time of enquiry or as soon as they become known
- Complying with all Supplier terms and conditions, including arrival procedures, house rules, and cancellation policies
- Paying for any damage caused to Supplier property by members of the travelling party
- Ensuring adequate travel insurance is in place (see Clause 9)
- Providing accurate and complete information to Balearic Collection throughout the planning and travel process
12. Complaints and Dispute Resolution
12.1 During Travel
If a problem arises during your stay, please contact Balearic Collection via the emergency contact number provided in your final Itinerary pack, and notify the Supplier directly. We will use reasonable endeavours to resolve the issue in real time.
12.2 Post-Travel Complaints
Any complaint not resolved during travel must be submitted in writing to contact@baleariccollection.com within 28 days of your return. We will acknowledge within 5 business days and provide a substantive response within 28 days.
12.3 Official Complaint Form (Hoja de Reclamaciones)
Balearic Collection S.L. makes available the official consumer complaint form (Hoja de Quejas y Reclamaciones) in accordance with Balearic Islands Tourism Law 8/2012. The official form is available at:

You may also request the form by emailing contact@baleariccollection.com. The time limit for filing a complaint is one month from the date of the incident or service failure.
12.4 Alternative Dispute Resolution
If a complaint cannot be resolved directly, you may refer the matter to AVBAL (Asociación de Agencias de Viajes de Baleares) or to the Junta Arbitral de Consumo of the Balearic Islands for independent mediation or arbitration.
13. Data Protection
Balearic Collection processes Client personal data in accordance with our Privacy Policy at www.baleariccollection.com/privacy-policy, and in compliance with GDPR and LOPDGDD. By engaging Balearic Collection, you consent to data being shared with Suppliers as necessary for the delivery of Services, and with the Spanish Ministry of the Interior where required by Royal Decree 933/2021.
14. Intellectual Property and Non-Circumvention
All Itineraries, proposals, and planning materials prepared by Balearic Collection are our intellectual property and are provided for your personal use only. They may not be reproduced, shared with third parties, or used as the basis for bookings made independently of Balearic Collection without prior written consent.
You agree not to contact, engage, or contract with any Supplier introduced by Balearic Collection in connection with services that were the subject of a proposal or Itinerary, without our prior written consent and without payment of the applicable Service Charge. This obligation applies for 24 months from the date of the relevant proposal. If circumvented, Balearic Collection reserves the right to invoice the Client for the full Service Charge that would have applied.
15. Governing Law and Jurisdiction
These Terms are governed by Spanish law. Any disputes are subject to the exclusive jurisdiction of the courts of Palma de Mallorca, Illes Balears, Spain. EU consumers retain the right to bring proceedings in the courts of their country of habitual residence under applicable EU consumer protection law.
16. General Provisions
- Entire Agreement: these Terms, together with the Service Charge Agreement and booking confirmation, constitute the entire agreement between the parties and supersede all prior discussions or representations.
- Severability: if any provision is found unlawful or unenforceable, it shall be severed and the remaining Terms continue in full force.
- Waiver: failure to enforce any provision at any time does not constitute a waiver of that right.
- Assignment: the Client may not assign rights or obligations under these Terms without our prior written consent.
- Amendments: the version of these Terms in force at the time of booking confirmation applies to that booking.
- Language: these Terms are written in English. In the event of any inconsistency with the Spanish version, the Spanish version prevails for legal purposes as required under Spanish law.
